Artist Licence Agreement

1.Parties and scope

EPRIS Museum (“the museum”, “we”, “us”) is a digital museum published at museum.eprisjournal.com as a division of EPRIS Journal. It is operated by Viacheslav Munister, director of EPRIS Journal and EPRIS Museum, [registered address, Milan, Italy]. You can reach us at munister@outlook.com.

This agreement is between the museum and you, the artist or rights-holder who submits work through the open call (“you”). It covers each work that we accept for a hall and that you confirm by paying the invoice for it (an “accepted work”). Submitting work does not by itself grant us anything: until a work is accepted and paid for, we only look at it to decide.

2.How the agreement is made

You accept this agreement by ticking the box on the open call form. For each work it takes effect when you pay the invoice for it under the Fee & Payment Policy, and lasts until the work is taken down.

3.What stays yours

You keep the copyright in every work and every other right you hold in it. This agreement is a licence, not an assignment. Your moral rights as an author under Italian copyright law (Law no. 633 of 22 April 1941) are unaffected: we will always name you as the author, as you ask to be named, and will not distort or alter the work.

4.What you license to us

For each accepted work you grant the museum a non-exclusive, worldwide, royalty-free licence, for as long as the work is in the collection, to:

1. reproduce and display it on museum.eprisjournal.com: in its hall, on its own work page, in search, in the artist index and on the scale wall;
2. make the technical copies the website needs: resized, compressed and re-encoded versions and thumbnails, including cropped thumbnails used only as a link to the full work;
3. show it in announcements of the museum itself (the EPRIS Journal and museum social accounts, newsletters and press material), always with your credit. You can opt out of this point when you submit, or at any time later, by writing to us.

The licence is not transferable, except to an organisation that takes over the running of the museum on these same terms; we would tell you first, and you could then withdraw the work.

5.What we will never do

• sell your work, prints of it or access to it;
• sublicense it or license it to stock agencies or other third parties;
• use it in advertising for anyone other than the museum itself;
• alter the image: no retouching, recolouring, overlaid text or watermarks;
• mint it as an NFT or any other token;
• supply it, or datasets that include it, for training machine-learning or AI systems;
• claim it as our own or remove your credit.

We cannot stop third parties from copying images that are publicly visible on the web. If we learn that someone is misusing your work taken from the museum, we will tell you and help where we can.

6.Works you have already released under Creative Commons

If you have published the work under a Creative Commons licence, everyone, including us, may already use it on that licence’s terms, and we print the licence beside the work. This agreement does not narrow that licence. It adds our own promises in sections 5, 7 and 9, which apply to the museum in any case.

7.Credit and presentation

Every accepted work is published with the artist name, title, date, medium and a credit line exactly as you give them to us, within the limits of what can be displayed. Send corrections at any time; we make them within five working days.

8.What you confirm to us

When you submit a work you confirm that:

• you made it, or you hold the rights needed to license it on these terms;
• showing it as described here does not infringe anyone else’s copyright, trademark, privacy or other rights;
• where an identifiable person appears, you have their consent to publish the image, and a parent’s or guardian’s consent for a minor;
• where the law requires permission to photograph or publish a place or object, you have it;
• the information you give us about the work is true.

If a credible claim is made against a work, we may take it down while we look into it. You are responsible for the accuracy of these statements; nothing here limits the rights you have as a consumer.

9.Taking a work down

At your request. You can ask us to remove an accepted work at any time, for any reason, without charge. We remove it from the public site within seven days; copies in backups and caches are overwritten within ninety days. Whether any fee is refunded is set out in the Fee & Payment Policy.

By us. We may remove a work if you breach section 8, if we receive a plausible rights claim, or when we rehang or close a hall. We tell you beforehand where we can, and give reasons.

10.Fees

The curatorial fee and how it is paid are covered by the Fee & Payment Policy, which forms part of this agreement. The fee pays for our work in cataloguing and publishing the work. It never buys selection: we decide what to accept before any fee is invoiced.

11.Liability

Each side is liable to the other under Italian law. Nothing in this agreement limits liability for wilful misconduct or gross negligence, or any liability that cannot be limited by law.

12.Law, changes and contact

This agreement is governed by Italian law. Disputes go to the courts of Milan, except that consumers may always use the courts of the place where they live. If we change this agreement, the version you accepted continues to apply to works already published unless you agree to the new one. Questions: munister@outlook.com.
